Terms of service — MotiveX

Acceptance

By downloading or using MotiveX you agree to these terms. MotiveX is operated by Mustafa Evleksiz. If you do not agree, do not use the app.

1. Eligibility

You must be at least 18 years old (or the age of digital consent in your country) to use the app. You confirm you are physically fit to use a fitness app or have a qualified professional's clearance.

2. The service

MotiveX is an iOS fitness and habit app — HealthKit-powered activity tracking, XP/streaks/levels gamification, an AI coach (MotiveKoç), Live Activities, widgets and an Apple Watch app. The app is provided 'as is'; we do not guarantee any specific health, fitness or behavioural outcome.

3. Accounts

You may sign in with email, Apple ID or Google. You are responsible for activity under your account and for keeping your credentials secure. You may delete your account at any time from Settings → Data & Privacy.

4. MotiveX+ subscription

How billing works:

• Some features require an active MotiveX+ subscription (monthly or yearly).
• Purchases are processed by Apple via RevenueCat and billed to your Apple ID. Subscriptions auto-renew unless cancelled at least 24 hours before the period ends; manage them in your Apple ID settings.
• Except where required by law, payments are non-refundable. Refund requests for App Store purchases are handled by Apple.
• We may change pricing prospectively; changes won't affect a billing period you've already paid for.

5. Acceptable use

You agree not to use the app to:

• Manipulate XP, streaks, leaderboard standings or HealthKit data.
• Upload content that is illegal, harassing or infringes third-party rights.
• Reverse engineer, abuse, overload or circumvent the app's limits or security.
• Use the AI coach in a way that endangers your or others' health.

6. Your content and data

You retain ownership of your activity records, mood entries and chat messages. You grant us a limited licence to process them solely to provide the service, including sending minimal context to Google's Gemini API to power MotiveKoç. We do not use your data to train AI models.

7. MotiveKoç (AI coach)

MotiveKoç's responses are generated from your numbers plus the Gemini AI model. Answers are informational and motivational only and do not constitute medical, nutritional, training or psychological advice. You are responsible for decisions you make based on the coach's output.

8. Health disclaimer

MotiveX is not a medical device and does not diagnose, treat, cure or prevent any disease. Step, calorie, distance and recovery values are sensor-based estimates and are not clinical measurements. Consult a qualified professional before starting any fitness programme.

9. Intellectual property

The MotiveX app, its branding and software are owned by us and protected by law. These terms grant you a personal, non-exclusive, non-transferable licence to use the app.

10. Termination

We may suspend or terminate access if you breach these terms or misuse the app. You may stop using and delete the app at any time.

11. Disclaimers

The app is provided 'as is' and 'as available', without warranties of any kind. AI output, HealthKit data accuracy and third-party service outages are outside our control.

12. Limitation of liability

To the maximum extent permitted by law, our total liability is limited to the amount you paid for MotiveX+ in the 12 months before the claim. We are not liable for indirect or consequential damages, including any health-related decisions you make based on the app.

13. Governing law

These terms are governed by the laws of Turkey, and disputes are subject to the courts of Istanbul, without prejudice to mandatory consumer protections in your country of residence.
