Terms of service — Cafe Brewly

Acceptance

By signing up for or using Cafe Brewly you agree to these terms. Cafe Brewly is operated by Mustafa Evleksiz. If you do not agree, do not use the service.

1. Eligibility

You must be at least 18 years old to create an account and act on behalf of a café. By signing up you confirm you are authorised to bind the café entity to these terms.

2. The service

Cafe Brewly is a web-based platform for café management — QR menu, order flow, kitchen and cashier views, and an AI assistant called Çırak. The service is provided 'as is'; we do not guarantee uninterrupted availability or any specific business outcome.

3. Accounts and roles

Owners create the café organisation and invite staff (waiter, kitchen, cashier). Each user is responsible for their credentials. Owners are responsible for the actions of staff accounts they invite, and for revoking access when staff leave.

4. Service availability and pricing

Cafe Brewly is currently in a pilot with Turkish cafés. Pilot accounts may be subject to feature limits and may be migrated to a paid plan with reasonable notice. We may introduce paid plans in the future; we will notify you and will never change existing pricing retroactively.

5. Acceptable use

You agree not to use the service to:

• Process orders or data on behalf of a café you are not authorised to represent.
• Upload content that is illegal, harassing, defamatory, or infringes third-party rights.
• Attempt to access another café's data, reverse engineer the system, or circumvent rate limits and security controls.
• Use the AI assistant for purposes other than your own café's operational analysis.

6. Your data and content

Your café retains ownership of all menus, orders, customer feedback, and operational data you enter. You grant us a limited licence to process this data solely to provide the service, including sending relevant summaries to Google's Gemini API to power the Çırak AI assistant. We do not use your café's data to train AI models or share it with other cafés.

7. AI assistant (Çırak)

Çırak's responses are generated from your café's own data plus the Gemini AI model. Answers are informational only and do not constitute professional financial, legal, tax, or business advice. You are responsible for decisions you make based on Çırak's output.

8. Intellectual property

The Cafe Brewly platform, its branding and software are owned by us and protected by law. These terms grant you a personal, non-exclusive, non-transferable licence to use the service for your café's operations.

9. Termination

We may suspend or terminate access if you breach these terms or misuse the service. You may stop using the service at any time; account deletion is available via support (see Privacy Policy §9).

10. Disclaimers

The service is provided 'as is' and 'as available', without warranties of any kind. Third-party service outages, AI inaccuracies, and user-entered data errors are outside our control.

11. Limitation of liability

To the maximum extent permitted by law, our total liability is limited to the amount you paid for the service in the 12 months before the claim (or, for pilot accounts, EUR 100). We are not liable for indirect or consequential damages, lost profits, or data loss caused by third-party outages.

12. Governing law

These terms are governed by the laws of Turkey, and disputes are subject to the courts of Istanbul, without prejudice to mandatory consumer protections in your country of residence.
